Terms and conditions

www.victorizare.com (hereinafter referred to as “The Site”) SASU with capital of 1 euro, whose Head Office is at 231, rue Saint-Honoré 75001 Paris, registered with the PARIS RCS under number 981 470 644, number intra-community VAT number FR 30 981 470 644 (hereinafter referred to as “the Company “Victor Izare or Victor Izare Paris”). All orders placed on the site www.victorizare.com are subject to these general conditions of sale. The Victor Izare Company reserves the right to adapt or modify these terms at any time, the version of the general conditions of sale applicable to any transaction being that appearing online on the site www.victorizare.com at the time of the order.

Items

I- THE CUSTOMER

The Customer declares to be a natural or legal person and to have the legal capacity allowing him to place an order on the site.

When recording the Customer's personal data in the “my account” section, the latter must ensure the accuracy and completeness of the mandatory data they provide. In the event of an error in the wording of the recipient's contact details, the Victor Izare Company cannot be held responsible for the impossibility of delivering the product. The Victor Izare Company reserves the right to cancel any order when the Customer's IP address is domiciled in a country different from the billing and/or delivery address.

II- THE PRODUCTS

The products offered for sale are those described on the Site. The Victor Izare Company takes the greatest care in the presentation and description of these products to best satisfy the Customer's information. However, it is possible that non-substantial errors may appear on the Site, which the Customer acknowledges and accepts. In any case, in the event of non-compliance of the product delivered with its description on the Site, the Customer may either exercise his right of withdrawal or implement the guarantee of conformity of the Victor Izare Company which will proceed , where applicable, either for exchange or reimbursement of the price (in whole or in part) possibly invoiced.

III- THE ORDER

Taking an order on the Site is subject to compliance with the procedure put in place by the Victor Izare Company, which consists of a succession of different steps that the Customer must follow to validate their order. The Customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the stipulations herein.

The Victor Izare Company may refuse any order from a Customer with whom there is a dispute or an incident relating to the payment of a previous order or who contravenes the provisions hereof.

In this case, the Victor Izare Company will inform the Customer by email. If the Customer fails to contact the Victor Izare Company to correct elements that are erroneous or contrary to these general conditions of sale, the Victor Izare Company reserves the right not to process the order.

A confirmation email summarizing the order (products, prices, product availability, quantity, etc.) will be sent to the Customer by the Victor Izare Company. To this end, the Customer formally accepts the use of email for confirmation by the Victor Izare Company of the content of his order. In any case, invoices are given upon delivery.

In the event of total or partial unavailability of the products ordered after placing the order, the Customer will be informed by email of the delivery of a partial order or of the cancellation of his order.

In accordance with the provisions of article L 121-20-3 of the Consumer Code, in the event of unavailability of the ordered product, the Customer then has the option:

- Either to be delivered with a product of equivalent quality and price, within the limits of available stocks;

- Or to be reimbursed for the price of the product or service ordered within 30 days of the request.

IV- PRICES AND PAYMENT TERMS

1. Price determination

The prices of the products are indicated in euros, all taxes included, excluding shipping costs. The total price of the order (including all taxes and shipping costs) is indicated on the payment page.

For deliveries outside French territory, the provisions provided for by the General Tax Code relating to VAT will apply.

The Victor Izare Company reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

2. Payment terms

The products are payable in cash on the day of the actual order.

Payment for purchases is made using a payment card. The payment cards accepted to date are: Carte Bleue, Visa, MasterCard.

The Customer guarantees that he is fully authorized to use the payment card to pay for his order.

 

Bank card: the Customer accesses a dedicated space made available by a banking establishment, which ensures the security and recording of the payment order. In this regard, the Customer expressly acknowledges that the communication of his bank card number to the Victor Izare Company constitutes authorization to debit his account up to the amount of the products ordered.

For each order, a request to debit the Member's bank account will be sent within 24 hours to their bank.

The order will be considered effective after confirmation of the agreement of the bank payment centers.

It is up to the Customer to save and print their payment certificate if they wish to keep their banking details and those relating to their transaction.

3. Recorded data

The data recorded and kept by the Victor Izare Company constitutes proof of the order and all past transactions. The data recorded by the payment system constitutes proof of financial transactions.

V- DELIVERY

Shipping is made to the delivery address indicated by the Customer, it being specified that this must be the residence address of the Customer or any other natural or legal person of their choice domiciled in France (including DomTom) or abroad. However, Victor Izare reserves the right to refuse certain orders from abroad for regulatory reasons or practical difficulties in transporting its products there. In this case, it will inform the Customer by email within 5 days of the order concerned and will reimburse all sums received for this order within 5 days of sending this email.

Shipping cannot be made to PO boxes.

In order for these deadlines to be respected, the Customer must ensure that they have communicated accurate and complete information concerning the shipping address (such as, in particular: street number, building number, staircase number, access codes , names and/or intercom numbers, etc.).

The Customer can opt for one of the following shipping methods:

Express shipping by DHL. Deliveries in mainland France of orders placed before 1 p.m. are generally made within 1 to 2 working days from Monday to Saturday morning, except public holidays. For other destinations, deliveries take between 2 and 4 working days depending on the destination.

Standard shipping by So Colissimo. Deliveries are generally made within 3 to 4 working days from Monday to Saturday morning, except public holidays. The order is delivered against signature to the delivery address indicated when ordering. In the event of absence during delivery, a delivery notice is left so that the Customer can collect their package from the nearest post office. Packages are held at the Post Office for 15 calendar days. In the event of non-collection within the time limit set by the carrier, the products will be returned to Victor Izare who, after having attempted to contact the Customer to agree on a new delivery, will proceed, in the event of failure, to reimbursement, including delivery costs, within 5 days of receipt of the package returned by Colissimo.

The delivery times indicated by Victor Izare are those generally observed. No refund of shipping costs will be made in the event of delivery taking longer than those indicated. The total time is therefore the product availability time + the shipping time linked to the processing and preparation of the order + the delivery time depending on the carrier and the destination country chosen.

 

Apart from delivery by courier, usual delivery times are 1 to 4 working days in France and 2 to 4 working days abroad depending on the country of destination. The deadlines indicated are indicative deadlines, corresponding to the average processing and delivery times. The Victor Izare Company cannot be held responsible for the consequences due to a delay in delivery not being its fault.

Late delivery In the event that the customer does not receive his package within 10 working days, he has the option of canceling his order.

Within 5 working days following the Customer's cancellation request, Victor Izare will make a request for the Customer's reimbursement from his bank.

 

Delivery made Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, materialized by the control system used by the carrier, such as the delivery tracking system offered on the La Poste website concerning “So Colissimo” for deliveries in France and on the UPS website for express deliveries in France or internationally.

 

It is up to the Customer to check shipments on arrival and to make any reservations and complaints that appear justified, or even to refuse the package, if it is likely to have been opened or if it shows obvious signs of deterioration. . Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days following delivery of the products, a copy will be immediately sent to Victor Izare.

VI- RIGHT OF WITHDRAWAL

You have 14 days from receipt of our shipment to return to us, without reason, any products ordered on the site www.victorizare.com

To make a return request, simply:

- log in to your account (top right of the screen)

- choose “Orders and Returns”

- click on “Return note”

- print the document to attach to your shipment in which all the instructions appear.

If a “Return Note” button does not appear with the order, it means that the period authorized for a return has passed.

Each year, the return period is extended during the holidays. All purchases made on our site from November 23 to December 23 can be returned until January 13 of the following year.

Returns are not possible on personalized products. Shipping costs are not refunded.

Reimbursements for returned products are made within a maximum of 5 days after receipt of said products.

VII – REIMBURSEMENT

Reimbursements for products in the cases referred to in Articles II and VI will be made by the Victor Izare Company within a maximum period of 5 days after receipt by it of said products.

VIII–COMPUTERS AND FREEDOMS

The information collected by the Victor Izare Company during an order from the Customer is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to the Victor Izare Company's service providers involved in the execution of the transaction. the command. The Customer is informed that these same personal data may also be collected by an organization responsible for analyzing orders and combating bank card fraud. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the Customer has the right to access, rectify, oppose and delete data concerning him or her.

X- APPLICABLE LAW

Any order automatically implies the Customer's acceptance of the general conditions of Sale. These general conditions of sale are governed by French law. In the event of a dispute, only the French Courts will have sole jurisdiction. In the event of a difficulty or complaint regarding an order, the Customer can contact Customer Service to find an amicable solution. In the absence of an amicable solution, the dispute will be brought exclusively before the Paris Courts.
